NORTH CAROLINA, USA — North Carolina legislative leaders have formally rejected Governor Josh Stein’s proclamation calling an extra session of the General Assembly on Monday, November 17.
In a letter addressed to the governor, Senate President Pro Tempore Phil Berger and House Speaker Destin Hall stated that the proclamation “fails to follow the requirements of the Constitution” and that the legislature will not convene.
The letter cites Article III, Section 5(7) of the North Carolina Constitution, which allows the governor to call the General Assembly into an extra session only on “extraordinary occasions.” The lawmakers argued that the General Assembly is already in session, making the proclamation ineffective and an unconstitutional attempt to override the legislature’s authority to
