What Ted Morton ignores is why Premier Danielle Smith used the notwithstanding clause in the first place. The UCP didn’t just legislate teachers back to work, they imposed a rejected contract that deliberately excludes the primary reason for the strike — class size and complexity.
Back-to-work legislation is invariably followed by binding arbitration. Smith forcibly removed that step for only one reason — because she knew she’d lose. Smith knows the teachers are right and she’s wrong.
And, as poll after poll confirms, Albertans know the teachers are right on this one.
This was not what Section 33 was meant for, and the premier knows it.
