WINCHESTER — A Frederick County Circuit Court judge has denied a defense request to force the federal Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) to turn over forensic analysis in the double-murder case against Jason Matthew Bowen.

Judge Alexander Iden said on Thursday that the commonwealth lacks the authority to compel a federal agency and that any attempt to order the ATF to produce documents would be outside the court’s jurisdiction.

Bowen’s attorneys, Eric Wiseley and Lisa Caruso, argued that the ATF’s forensic data — particularly information related to DNA found on shell casings recovered from the Frederick County crime scene — is essential to testing the prosecution’s evidence and preparing for cross-examination.
