WINCHESTER — A Frederick County Circuit Court judge has denied a defense request to force the federal Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) to turn over forensic analysis in the double-murder case against Jason Matthew Bowen.
Judge Alexander Iden said on Thursday that the commonwealth lacks the authority to compel a federal agency and that any attempt to order the ATF to produce documents would be outside the court’s jurisdiction.
