(WKYT) — For today’s Good Question, Roger asks: Does a college athlete still get paid NIL money if they don’t play in their games?
Yes, they do. Unlike professional sports contracts, which may have provisions tied to the number of games played, wins, or post-season accomplishments, NIL deals cannot be tied to an athlete’s performance on the field or court.
NCAA bylaw prevents performance-based pay
The NCAA bylaw, Article 22, which covers Name, Image and Likeness Activities, includes the line, “Name, image and likeness activities may not be used to compensate a student-athlete for athletics participation or achievement.”
It also says those NIL deals may not be used as an inducement for an individual to enroll or remain enrolled at a specific institution.
