A bill to amend Canada’s unconstitutional citizenship-by-descent rule has passed the last hurdle to become law with approval by the Senate, but a new fight is looming as others seek equal recognition of their citizenship rights.
The Senate’s passage of Bill C-3 on Wednesday marked another milestone in the years-long battle by “lost Canadians,” who successfully challenged a law enacted by the former Conservative government in 2009 to deny the first generation born abroad the right to pass on citizenship by descent to the second generation born abroad.
The bill will now proceed to royal assent by the Governor General and must be enacted before Jan. 20, a deadline set by the Ontario Superior Court of Justice . The proposed changes are meant to restore and grant citizenship by descent to
