Lawyers argued Thursday that the New Hampshire Supreme Court Thursday should uphold the jury’s decision to award David Meehan $38 million in damages after the panel found the state 100% liable for hundreds of sexual assaults at the former Youth Development Center in the 1990s.

The issue has been hotly debated for more than a year since t he state objected to the award, contending it only must pay out $475,000 because of a sovereign immunity cap after the jury only listed one “incident” of abuse on the verdict form.

Superior Court Judge Andrew Schulman previously ruled that no reasonable jury could have found less than 116 incidents after a civil trial which lasted about a month last year.
