A city of Santa Fe resolution calling for signs to alert visitors guns are prohibited at certain facilities that serve children does not violate the New Mexico Constitution, a state district judge ruled this week.
First Judicial District Judge Kathleen McGarry Ellenwood granted the city's motion for summary judgment in a lawsuit filed two years ago by Santa Fe resident Aaron Perls challenging the measure.
McGarry Ellenwood ruled Perls lacked standing to challenge the resolution, approved in January 2023, and failed to provide proof of his claims the measure violates state law. Perls could still attempt to appeal the decision to a higher court.
Santa Fe Mayor Alan Webber, one of the sponsors of the measure and an advocate for stricter gun enforcement, hailed the decision.
