The U.S. Supreme Court has agreed to weigh in on the ongoing fight between a New Jersey anti-abortion center and the state’s Attorney General.

The case centers around an investigatory subpoena that state Attorney General Matthew J. Platkin issued to First Choice Women’s Resource Centers in November 2023 for a wide range of documents and information, including the names of most of its donors. The state is seeking the records as part of an investigation into whether First Choice misrepresented itself to donors and the public.

First Choice, which describes itself in court filings as a “faith-based pregnancy resource center,” sued in federal court.

The nonprofit argued that the subpoena violated its First Amendment rights because it was “borne of retaliation or viewpoint discrimination.”
