ALBANY, N.Y. -- Another federal judge heard arguments Thursday about the legitimacy of a top Trump administration prosecutor as New York Attorney General Letitia James challenged the authority of the acting U.S. attorney probing two of her high-profile cases.

Also Thursday, the Justice Department failed to secure a new indictment against James after a judge dismissed the previous mortgage fraud prosecution encouraged by President Donald Trump, according to people familiar with the matter.

James contends the administration twisted the law to make John Sarcone the acting U.S. attorney for northern New York and is challenging Sarcone's authority to oversee a Justice Department investigation into regulatory lawsuits she filed against Trump and the National Rifle Association.
