Philip Chancey, a man accused of swindling investors out of more than $350,000 in fraudulent business deals, has had his trial pushed back for a third time.

His trial was supposed to take place this month, but a postponement was granted after defence lawyer Jon Noonan said he has been unable to retrieve any documents from Chancey's previous lawyer, Don Powell.

Noonan said the documents in Powell's possession are vital to his client's defence in court.

"If [Chancey] is convicted without [me] having access to his defence evidence — and without having sufficient time to assess it, call appropriate witnesses, etc. — it could very well result in a wrongful conviction," Noonan wrote in his application for a postponement.
