A 13-year-old boy has been indicted on first-degree murder charges after a botched armed robbery in Cocoa according to the State Attorney's Office for the 18th Judicial Circuit.

Kelby Miller, 30, was shot and killed in the November incident.

Miller drove to a vacant house on Bristol Drive to meet an unknown person he had been texting with via a social media app, the report says.

After Miller messaged the unknown person that he had arrived, the 13-year-old approached and attempted to rob him, shooting him once in the torso with a .45 caliber handgun, the SAO said.

Severely wounded, Miller called 911 and reported that he had been robbed. However, Cocoa police officers found he still had his cellphone, keys, wallet and money. Miller told officers that "only one person was responsible for
