GROVES, Texas — An appeals court has upheld the conviction of a Port Arthur man sentenced to 76 years in prison for a 2022 shooting outside the McDonald’s in Groves.

Darryl Dwayne Prevost challenged his conviction before the Ninth Court of Appeals, arguing that he acted in self-defense and under “sudden passion” when he shot Alfonso Solomon. Prevost claimed there was insufficient evidence to prove he did not fear for his life, saying he believed Solomon was reaching for a gun.

He also argued that the stress of the confrontation left him incapable of “cool reflection,” a requirement for a sudden-passion finding that can reduce a sentence.

But the appellate court disagreed, ruling that jurors were presented with enough evidence to reject both claims. Justices pointed to video footage show
