U.S. District Court Judge Paula Xinis, an appointee of former President Barack Obama, on Thursday ordered the U.S. Department of Homeland Security (DHS) to immediately release Kilmar Abrego Garcia from Immigration and Customs Enforcement (ICE) custody, claiming that the 2019 final order of deportation issued by Immigration Judge David M. Jones is an invalid document for his removal.
While Abrego Garcia was deemed eligible for deportation by an immigration in 2019, when Jones wrote, "Respondent, through counsel, admitted the factual allegations contained in the [Notice to Appear] and conceded eligibility," and further that Abrego Garcia's admissions led the court to find," his removability to be established by clear and convincing evidence," as required by the Immigration and Nationality
