A grand jury on Wednesday concluded that a Clackamas County sheriff’s deputy was justified in shooting a man who charged at her on Nov. 9.

Deputy Lindsay Bailey shot 44-year-old Daniel Zimmerman at his family’s property in Boring. Zimmerman survived and faces charges of menacing and second-degree disorderly conduct for the incident, court records show.

Before the shooting, Zimmerman’s father called 911 and reported that his son had set a utility trailer on fire and was piling wood onto the bonfire, a probable cause affidavit states.

He added that Zimmerman was intoxicated and “freaking out” from a possible mental health crisis, court records show.
