The Nevada Supreme Court is considering whether the ACLU of Nevada is entitled to the components of the investigative file for the Clark County School District Police officer who threw a Black student to the ground and knelt on his back nearly three years ago.
The latest stage in the ACLU’s long-running public records fight with CCSD hinges on the Clark County District Court’s interpretation of a state law that allows a police officer to see evidence against them if their agency seeks to punish the officer. But because neither CCSD or CCSDPD punished Lt. Jason Elfberg, the officer at the center of the February 2023 incident outside Durango High School, the lower court judge concluded that the final report and full file should remain confidential.
