A 5-year-old girl was found dead of carbon monoxide poisoning after workers at a New Mexico Children, Youth and Families Department office in Silver City failed to intervene despite multiple investigations looking into claims of neglect of her and her brother, a recent lawsuit alleges.

Xaqueline “Xaquie” Bynum had been dead for some time when she was found in March 2024, the day after celebrating her 5th birthday in her family’s tiny, single-room home, described by authorities as a “shack,” according to the lawsuit, filed last week in state District Court in Santa Fe by the wrongful death estate of Xaqueline and a guardian ad litem of her brother. Xaqueline and her brother were both found to also have methamphetamine in their systems.
