An Allentown police officer knew a fleeing suspect was unarmed and surrendering peacefully when he attacked him with his department-issued firearm , authorities said.

Lehigh County District Attorney Gavin P. Holihan and Allentown Police Chief Charles Roca announced the charges Thursday afternoon in a news conference against city police Patrolman Abviud Carvajal.

Both called the assault unjustified against 54-year-old Thomas Kravitz of Philadelphia.

Carvajal, 30, of Allentown, is charged with felony aggravated assault and misdemeanor simple assault. Carvajal surrendered to city police on Thursday and was arraigned on the charges before District Judge Todd P. Heffelfinger. He is free on $25,000 unsecured bail.
