NEW YORK — The New York State Office of Cannabis Management can continue making unannounced inspections of unlicensed cannabis shops after a judge ruled the practice is constitutional.

In The Elfand Organization, LLC d/b/a Empire Cannabis Club v. State of New York, et al., the court dismissed the case in it's entirety, finding that OCM's inspection framework does not violate the Fourth Amendment or the New York State Constitution. The decision outlines that inspection laws are clearly defined, properly limited in scope, and designed to serve regulatory, not criminal, purposes.
