Bartholomew County prosecutors have acknowledged that investigators failed to disclose certain information to the defense during the trial of Jason Hubbell — who was convicted and sentenced in 1999 to 75 years in prison for the abduction and murder of Sharon Myers — but argue the withheld evidence is unlikely to have changed the trial’s outcome.

The withheld information includes statements allegedly made to investigators in Johnson County in 1997 as they were investigating the abduction, rape and murder of Franklin College freshman Kelly Eckart, according to court filings.

Prosecutors argue that the withheld material includes hearsay that would not have been admissible as evidence at trial — and in one instance, also contains information that could have implicated Hubbell in Myers’ death
