LEXINGTON, Ky. (FOX 56) — Lexington home and business owners have filed suit against the Fayette County Board of Education, claiming the district purchased, developed, and even encroached on land it didn't own due to an exemption from being subjected to local land use laws.
In the lawsuit, Attorney Bruce Simpson, who represents homeowners Theresa Leito and Kristofer Zander, wrote that in October 2024, the board of education bought land at the 1600 block of Versailles Road for $10 million, destroying a "substantial urban forest" and a historic home.
When the homeowners asked district representatives about the development project, they were allegedly met with vague answers that left Leito and Zander "bewildered" about what was about to allegedly unfold.
