YUMA, AZ (AZFamily) — Yuma Border Patrol agents arrested a man Sunday evening whose family said is a recipient of the Deferred Action for Childhood Arrivals (DACA) program. His wife is calling for his release.

Cellphone video shows the moments after 27-year-old Jose Valdovinos left a Circle K gas station and was pulled over by Border Patrol. In the video, a woman is heard questioning agents.

“Why are you taking him? You don’t have a reason to pull him over,” she said.

“We do have a reason,” an agent responded. When she asked if it is “because he is brown,” the agent replied, “We don’t have to give it to you.”

Valdovinos was in the passenger seat while his wife, Jitzell Flores, was driving. Flores said they did not learn the reason for the stop until minutes later.
