The proposed amendments to the Critical Lands Overlay Zone will cut protections along all natural jurisdictional streams and rivers as soon as the amendments are passed into Logan City law. This will cut the 2023 riparian protections for all undeveloped lots, and it negatively impacts the North Branch of the Logan River, known as the Little Logan River.
If passed as written, riparian protections added in 2023 - just two years ago - will be removed. The setback for structures will drop from 100’ to 25’, and the 50’ “NON-DISTURBANCE ZONE” will be eliminated.
All lots without a current building permit granted at the time of this code amendment will be relieved of the current restrictions, and held to the new diminished standards. This is assured by the “Vested Rights Rule”, which locks in t
