LINCOLN, Neb. (WOWT) - A federal judge sided with the Nebraska ACLU in a case where her bond was denied after an automatic stay was placed on her by ICE.
An immigration judge granted Maria Reynosa-Jacinto a $9,000 bond two weeks after ICE detained her.
However, her bond payment was denied after it was discovered that ICE had placed an automatic stay on her release, essentially blocking it from being posted.
In response, the ACLU filed a lawsuit , saying the automatic stay violated her due process under the Fifth Amendment.
They also claim it extends beyond ICE’s authority by overriding the judge’s decision on bond.
Reynosa-Jacinto was one of nearly 80 people detained at Glenn Valley Foods in June. Since then, she’s been held at the Lincoln County Detention Center in North Platte
