A 2024 law requiring a seven-day waiting period for most gun sales in New Mexico is unconstitutional, two federal judges held in an opinion released Tuesday .

A three-judge panel of the 10th Circuit Court of Appeals ruled 2-1 that the law, one of the most controversial measures to pass during the 2024 legislative session, infringes on New Mexicans' Second Amendment rights.

"Cooling-off periods do not fit into any historically grounded exceptions to the right to keep and bear arms, and burden conduct within the Second Amendment’s scope," the majority opinion states. "In this preliminary posture, we conclude that New Mexico’s Waiting Period Act is likely an unconstitutional burden on the Second Amendment rights of its citizens."
