OLATHE, Kan. (KCTV) - A Johnson County man has been charged with a pair of felonies just over a year after a crash killed an Olathe teenager.

Johnson County District Attorney Steve Howe announced Thursday that 49-year-old Matthew Thomas Bray has been charged with aggravated battery while driving under the influence and leaving the scene of an accident involving great bodily harm.

Bray’s charges were the result of a July 27, 2024, crash on southbound I-35 near Johnson Drive.

Seventeen-year-old Benjamin Van Buskirk, a rising senior at Olathe South, was stopped to help a woman whose vehicle had stalled. Van Buskirk was struck and killed.

Howe said Bray is being held in the Johnson County Detention Center on a $25,000 bond. His next hearing is scheduled for Aug. 27, 2025, at 10 a.m.
