A man is being charged with felony assault after spitting on National Guard troops from South Carolina who were standing outside of Washington, D.C.'s Union Station.
Reuters legal reporter Brad Heath spotted the Justice Department filing that outlines the allegations.
The statement of facts aleges that on Friday, Aug. 22, Scott J. Pichon was riding an electric scooter past two Guard soldiers when Sergeant Robert Underwood claims he heard the "man make a noise like he was coughing up mucus." Sgt. Underwood alleged that he observed Pichon spit "a mixture of saliva and mucus" on the men.
It allegedly landed "on the chest and face area." The man didn't stop the scooter as the incident unfolded, the claim said. The surveillance video shows Pichon riding by on his scooter and the men "reacting" to being allegedly spat on, but it doesn't appear to show actual spit flying toward the men.
The incident is the second that former Fox News personality Jeanine Pirro has filed since President Donald Trump deployed an occupation force into Washington, D.C.
The first incident involved a Justice Department lawyer throwing a sandwich at federal officers. He has something of an icon across the district, with posters popping up over the weekend using the famous Banksy painting of a man who appears to be throwing a bomb, but instead it's a bundle of flowers. The posters of "Sandwich Guy" replace the flowers with a submarine sandwich.
