A former federal prosecutor chided one of President Donald Trump's lawyers on Wednesday after she suffered a series of defeats in court.

Glenn Kirschner, who served as an assistant U.S. attorney in Washington, D.C., joined progressive YouTuber Brian Tyler Cohen on "The Legal Breakdown" to discuss the recent case where a paralegal at the Department of Justice was arrested for throwing a sandwich at a police officer.

Jeanine Pirro, the former Fox News host who is currently serving as the United States Attorney for the District of Columbia, tried to indict the sandwich-throwing man for felony assault. However, a grand jury refused to indict the individual, which Kirschner described as a "consequential legal decision."

"It looks like an assault because it's an unlawful touching or unlawfully making contact with somebody, which constitutes a kind of assault which we call a battery," Kirschner added. "But Janine Piro...the top prosecutor, said, 'We are marching forward with a felony assault charge.'

"And the grand jury said, 'Yeah, not so fast, Janine. Back up because you've got to go through us, the grand jury, and we reject your overreach, your abuse of prosecutorial power,'" he continued.

Kirschner also noted that it is considered easy to indict someone through the grand jury process because of the relatively low evidentiary requirements.

"Apparently, a grand jury will indict a ham sandwich, but not a Subway sandwich or a person who throws a Subway sandwich at a police officer," Kirschner said.
