ATLANTA, Ga. (Atlanta News First) - The Atlanta-based Delta Air Lines has agreed to pay millions to settle a fuel-dumping class-action lawsuit in California.
According to federal court documents, Delta will hand over $78,750,000. But despite the payment, Delta “vigorously denies all claims” and admits no liability, the settlement said.
The lawsuit stems from an incident on Jan. 14, 2020, when a Delta-operated flight on its way to Shanghai, China, had to turn back to the Los Angeles International Airport due to an engine malfunction. The crew jettisoned fuel during the return to reduce the risk of an overweight emergency landing, according to the settlement.
The plaintiffs argue the dump — which affected thousands of properties, including homes and schools —was a form of trespassing.
