A federal appeals panel has thrown out a lawsuit against the city of Warren for charging one of the defendants in a well-publicized football hazing incident six years ago at De La Collegiate High School.
A panel of the Sixth Circuit of the U.S. Court of Appeals in Cincinnati decided 3-0 to dismiss all four claims against the city that were made by Cleveland Harville, one of seven players at the Warren parochial school who were charged with misdemeanor assault and battery for an alleged incident of restraining a teammate and threatened to touch or touching the accuser in the thigh with a broomstick in the locker room.
After its initial July ruling, the panel last month denied a rehearing on the case filed by Harville’s attorney.
