BECKER COUNTY, Minn. — Former Senator Nicole Mitchell 's sentencing for burglary is delayed because her attorney needs time to recover from an illness.

Mitchell's attorney, Dane DeKrey, filed a motion to continue the sentencing hearing that was scheduled for Sept. 10. It will now be held on Sept. 23.

DeKrey's motion states he "has an illness that precludes him from adequately preparing for the September 10th hearing. A short continuance will allow Mr. DeKrey to recover from this illness and then Ms. Mitchell's sentencing hearing can occur."

In July, a Becker County jury found the former Minnesota State Senator guilty of breaking into her stepmother's home.

Mitchell was charged with burglary and possession of burglary tools for the April 2024 break-in.
