A lawsuit filed in 2019 against the West Ada School District over kindergarten fees is still pending, though the district has remedied the initial complaint.

Peyton Gifford and Mollie Gabaldon filed a lawsuit six years ago when asked to pay for full-day kindergarten. Because of the fees, they did not enroll.

The lawsuit claimed the district’s tuition fees violated the Idaho Constitution’s “free common schools” language.

At the time of the lawsuit, the West Ada district charged $300 a month to enroll children in the second half-day of kindergarten class. But full-day kindergarten has been free for West Ada families for the past three years.

The lawsuit was once dismissed because Gifford and Gabaldon did not pay any fees .
