ALBUQUERQUE, N.M. (KRQE) – The teacher accused of inappropriately touching students is now asking the New Mexico Supreme Court to release him from jail. Kelly McEachran is accused of inappropriately touching a student last school year and another one in the 2016-2017 school year.

In July, a judge granted the state's motion to keep McEachren in jail until trial. Now, his attorney is appealing that decision, arguing the state did not meet its burden that there are no conditions of release that could keep the community safe. McEachren's attorneys are asking the New Mexico Supreme Court to respond by Wednesday.
