ORCHARD PARK, N.Y. — The family of James Cushman has filed a lawsuit claiming Orchard Park police used excessive force when officers shot him during a mental health crisis last August.

The family first announced their intent to sue in May .

Cushman was shot after police say he refused multiple commands to drop a knife and advanced toward officers. According to the lawsuit, Cushman’s mother asserts that her son had already put down the knife before the situation escalated.

Autopsy results included in the lawsuit show that Cushman was shot seven times, including five shots from behind.

The lawsuit also highlights Cushman’s mental health history, citing conditions such as psychosis, paranoia, and severe anxiety.
