An officer at 3:48 a.m. on Aug. 23 stopped a pickup truck on I-480 eastbound after observing it failing to remain within its lane.

Upon approaching the driver, the officer noticed a strong odor of an alcoholic beverage coming from the vehicle, according to a police report. The driver said he was coming from a bar. The driver, when asked how much he had to drink, replied, “Not that much.” When asked if he was safe to drive, the man responded by shrugging his shoulders, according to the police report.

The man declined to answer when asked if he would perform field sobriety tests and refused to submit to an alcohol breath test, according to the police report. The man was cited for operating a vehicle while intoxicated and for not driving within marked lane
