Lawyers representing a downtown building filed a lawsuit last week over the City of Bozeman’s approval of site plans for a hotel on Mendenhall Street.

The Boutique Hotel is planned for East Mendenhall Street on a lot between north Bozeman and Rouse avenues, directly behind the Rocking R Bar, Brigade and other bars and shops.

City commissioners voted 3-2 in August to approve the site plans for a six-story hotel with a patio encroachment into the required setback for Bozeman Creek. The site plans were fairly controversial — city commissioners originally voted against the plans in May, but agreed to reconsider them at the developer’s request.
