Second Amendment Foundation seeks swift resolution to lawsuit over law prohibiting firearms in licensed homes.

The Second Amendment Foundation (SAF), along with several co-plaintiffs, has filed a motion for summary judgment in its lawsuit challenging an Illinois law that bans firearms in homes licensed for foster or day care. The lawsuit, Miller v. Mueller , argues that the state’s regulations unconstitutionally strip caregivers of their right to self-defense.

The Illinois Foster Home and Day Care Home Rules and statutes prohibit licensed foster parents and day care providers from keeping functional firearms in their own homes, even if they are otherwise legally permitted to possess them. This ban, according to the SAF, is a violation of fundamental rights.
