BURLINGTON, Iowa —
The Iowa attorney general's office says a Des Moines County sheriff's deputy acted with legal justification when he fatally shot a man while responding to a domestic disturbance in rural Burlington last month.
On Aug. 5, deputies were dispatched to the domestic disturbance shortly after 9 p.m. The caller had reported that her live-in boyfriend, David Maupin, was intoxicated, causing property damage and possessed a shotgun in front of her and her 3-year-old child.
According to the attorney general's office, when Deputy Brett Haubrich arrived at the scene, Maupin was in a dark, detached garage. Maupin exited the garage but refused to comply with the deputy's commands and told the deputy he was going to shoot him before going back into the garage.
