COLUMBUS, Ohio — A recent ruling is a legal victory for Ohio State students and parents involved in a mold issue inside Lawrence Tower on the campus of The Ohio State University.
On Monday, Judge David Cain of the Court of Claims granted plaintiffs all but one of their claims against the university.
The judge denied the claim of fraud.
As a result of the judge’s ruling, the attorney representing the plaintiffs can move forward with claims of negligence, implied warranty of habitability, the negligence per se claim and a nuisance claim.
10TV has followed the case since last year, when students claimed they began to feel ill due to the air quality inside Lawrence Tower.
Ohio State says it doesn’t comment on pending litigation, but in court filings the university “denied allegations tha
