BOISE, Idaho — Meridian City Council voted 5-1 on Tuesday to deny a conditional use permit for what could become the city's second In-N-Out Burger restaurant on North Ten Mile Road.

Earlier this spring, Meridian's Planning and Zoning Commission turned down In-N-Out's request for a conditional use permit. The main reason was concerns that the restaurant's late hours and expected drive-through traffic could cause problems for nearby residential areas and increase congestion along nearby drive aisles and public streets.

Representatives of In-N-Out Burger appealed the decision, and during Tuesday's City Council meeting, presented revised information . Under the revised proposal, the restaurant would close nightly at midnight and restrict routine deliveries to between 6 a.m. and 10 p.m.,
