OTTAWA — The Federal Court of Appeal has denied an application for another stay order to delay a cull of about 400 ostriches at a B.C. farm.
The ruling is the latest in the legal fight by Universal Ostrich Farms in Edgewood to stop the cull ordered by the Canadian Food Inspection Agency.
The agency ordered the cull in December during an outbreak of H5N1 flu that killed 69 ostriches at the farm that month and in January.
While the farm’s supporters argue the surviving birds are not a threat and can be used for research, the agency has maintained that the cull is necessary because exposed flocks create an opportunity for the virus to mutate.
