Retired Utah State District Court Judge Richard D. McKelvie found “numerous examples” of interference by Wasatch County Sheriff Jared Rigby and/or Undersheriff Josh Probst in cases, including the death of Patrick Hayes, 61, who was shot near Ross Creek on Sept. 25, 2024.

McKelvie was asked to initiate an investigation of alleged misconduct and wrongdoing in the Sheriff’s Office in March, following public safety complaints brought to the Wasatch County Council. McKelvie provided his findings to Wasatch County officials, who released the full report Friday afternoon.

McKelvie’s investigation said that Rigby and Probst “immersed themselves in investigations at times and in a manner that frustrated detectives and deputies pursuing the investigations.”
