BUFFALO, N.Y. — One month ago, State Supreme Court judged Emilio Colaiacovo issued a ruling that mandates the New York State Department of Transportation conduct an Environmental Impact Statement for the Kensington Expressway project.

Since the ruling, the NYSDOT has not declared its intentions with the $1.5 billion project that aims to cap and tunnel a 4,100-foot section of the Kensington Expressway between Best Street and Sidney Street.

The judgment is expected to be docketed with the court within a week. At that point the NYSDOT will have a 30-day window to appeal Judge Colaiacovo's decision.

However, the lead attorney for the East Side Parkway Coalition says that according to his conversations with the legal team for the NYSDOT, an appeal might not be immediate.
