COLUMBUS, Ohio – Marijuana became legal to use recreationally in Ohio in December 2023, a month after the statewide ballot initiative passed. But legal sales at dispensaries didn’t start until Aug. 6, 2024.
Although there is some conflicting language, the state statute generally prohibits recreational marijuana use in public , according to the Division of Cannabis Control, which is part of the Ohio Department of Commerce. Anyone who does so could be charged with a misdemeanor, according to the state.
But rules about public use are somewhat unclear. Despite the threat of a misdemeanor, the statute states that property owners and “any public place” can decide for themselves whether to accommodate marijuana use.
