Undaunted by five years of unsuccessful litigation initiated by predecessors, the Flagstaff City Council announced on Wednesday, Sept. 17, it is prepared to bring additional legal actions against helium producer Desert Mountain Energy over possible drilling operations near Red Gap Ranch.

The announcement followed the Arizona Supreme Court’s Sept. 9 rejection of the city’s petition for review in an ongoing lawsuit with the company. Members of city council met with the city attorney in an executive session on Tuesday, Sept. 16, and formally ratified the decision to authorize “potentially refiling litigation against Desert Mountain Energy” in their public meeting the same day.
