The Hershey Company is off the hook for a class action lawsuit filed by Florida consumers claiming its Halloween-themed Reese’s Peanut Butter Cups and others were misleading.
On Sept. 19, a federal judge in Florida dismissed the suit which claimed several Reese’s candies, including pumpkins, bats and footballs, were plain and lacked decorative details shown on the packaging.
According to Reuters, U.S. District Judge Melissa Damian ruled the plaintiffs didn’t offer enough evidence to prove they suffered economic harm because the candies were blank and didn’t contain “artistic carvings” of triangular eyes and crooked mouths.
