OKLAHOMA CITY (KFOR) — Three years have passed since Sgt. Bobby Swartz was killed in the line of duty; his family is still waiting for justice.

"There's a lot of systemic failures with state agencies involved that, in my opinion, have allowed it to get to this point," said Bobby's son, Austin Swartz.

In 2023, Swartz's alleged killer, Benjamin Plank, was ruled incompetent to stand trial.

Earlier this month, Oklahoma County Judge Kathryn Savage ruled the State Department of Mental Health and Substance Abuse Services did not properly administer antipsychotic medication to Plank.

A previous court order allowed the involuntary administration of the medication to Plank, something Judge Savage found the agency did not comply with, according to a recent filing.
