The Supreme Court remarked that the property of a Hindu woman dying without a will and leaving behind no husband and children goes to her husband's heirs and not to her family as her "gotra" changes when she marries under the Hindu law.

These remarks came on Wednesday while the top court was hearing a plea challenging Section 15(1)(b) of the Hindu Succession Act, 1956, which provides that when a Hindu woman dies intestate, her property passes to her husband’s heirs if she leaves no husband or children.

During the proceedings, the bench led by Justice BV Nagarathna reminded petitioners to consider the cultural framework underlying the law.
