SPOKANE, Wash. – Kevin Coe, a convicted rapist who spent 20 years in involuntary commitment after serving his sentence, is scheduled to appear in court next week. However, the State of Washington is asking a judge to dismiss the hearing meant to determine his fitness for release.

The Attorney General’s Office filed a request stating it lacks sufficient evidence to continue Coe’s involuntary civil commitment. The state cannot prove Coe suffers from a mental abnormality or personality disorder that makes him likely to engage in predatory acts of sexual violence, they said.

The state has requested the court dismiss the case without prejudice. This issue is expected to be discussed during the October 2 hearing.
