All options are now closed for MNCs like Nestlé SA as the Supreme Court has dismissed a curative petition filed by the company against the earlier ruling on dividend taxation. The ruling by the apex court in this matter had led to the suspension of India’s Most Favoured Nation (MFN) status by Switzerland.
“In our opinion, no case is made out within the parameters indicated in the decision of this Court in Rupa Ashok Hurra vs. Ashok Hurra & Anr. reported in 2002(4) SCC 388. Hence, the Curative Petition is dismissed,” a bench of Chief Justice B R Gavai and Justices Surya Kant, Vikram Nath and Dipankar Gupta said on the petition filed by Nestle SA. A curative petition is filed by aggrieved party after review petition for re-considering adverse ruling is dismissed. This is considered as a l
