California Governor Gavin Newsom should be charged criminally for describing Stephen Miller as a "fascist," according to a Republican lawmaker.

On Friday, Newsom's press office posted this on X: "STEPHEN MILLER IS A FASCIST!" MAGA accused Newsom of "trying to get Miller killed" with the simple comment on social media. Miller is currently the White House deputy chief of staff under Trump.

Republican Rep. Derrick Van Orden (WI) went as far as to allege criminality on behalf of the governor.

"At this point, this reaches the threshold of domestic terrorism," the lawmaker claimed. "This is no longer 'inflammatory', it is criminal."

He went on to cite 18 U.S. Code § 2331, and say, "No one is above the law, @CAgovernor."

Ex-prosecutor Ron Filipkowski flagged the comment, saying, "Congressman wants Gavin Newsom arrested for terrorism because he called Stephen Miller a fascist."

"The hundreds of times Miller called Democrats fascist apparently doesn’t count for anything," he then added Sunday.
